Privacy Policy:

We prioritize the confidentiality of any information collected. Your email, name, and phone number, if provided, are strictly for internal use and future promotional marketing purposes. Rest assured, we do not share or sell your information to any third-party entities. You retain the option to unsubscribe from promotional communications at any time. Your trust and privacy are of utmost importance to us.

Rights:

Zamora Digital Studios (“COMPANY”) retains exclusive ownership of all photographs and videos produced, unless otherwise agreed upon in writing.

The COMPANY grants the Listing Agent (“CLIENT”) a limited license to use these images and videos exclusively for marketing the property during the active listing period. This license is valid for one (1) year from the date of delivery. The CLIENT may use the images and videos for property-specific marketing materials, promotional campaigns, and self-promotion during the license term. Additionally, the CLIENT's parent company is permitted to use the images solely for marketing the listed property.

Any use of the images or videos by third parties—including but not limited to architects, builders, stagers, designers, sellers, or buyers—is strictly prohibited without prior written consent from the COMPANY.

Relationship of the Parties:

The COMPANY operates as an independent contractor and is not to be considered an employee of the client. This agreement does not establish any agency, partnership, joint venture, or employer-employee relationship between the parties. Neither party is empowered to act as an agent or bind the other, except as explicitly outlined in this agreement. It is expressly stated that the photographer, as well as the photos, videos, or any other deliverables, does not fall under the classification of a work-for-hire as defined by Copyright Law. All rights extended to the client are contractual and explicitly defined within the confines of this agreement.

Payment/Fees:

To secure our services, a 50% partial payment of the total amount must be settled before the scheduled appointment date. Scheduling of the appointment will only occur upon successful completion of this initial payment. The remaining 50% will be invoiced upon delivery of the media to the client. Zamora Digital Studios reserves the right to cancel, postpone, or reject the scheduling of subsequent photo shoots until the client's account is fully settled and up to date.

Reshoots:

Our commitment is to deliver work that surpasses our customers' satisfaction. However, should the CLIENT find any valid reason for dissatisfaction with the images, we offer a complimentary reshoot.

The CLIENT is granted a 3-day window to decide whether they require a reshoot. If no explicit reshoot request is received by the COMPANY within this timeframe, the option for a reshoot will be considered forfeited.

Before scheduling a reshoot, it is the responsibility of the CLIENT to clearly communicate the specific images causing concern and articulate the reasons for their dissatisfaction. A rescheduled appointment date will only be arranged once this information has been effectively conveyed to the COMPANY.

Cancellations/Rescheduling:

Kindly inform us at least 48 hours in advance if you need to cancel the scheduled shoot.

For cancellations made within 48 hours, a 50% fee will be charged. Please be aware that the entire shoot amount will be levied if the COMPANY arrives at the property to find the shoot canceled, including instances of denied access or the home not being ready for photos. It is the responsibility of the CLIENT to ensure timely access to the property at the scheduled time.

Indemnification:

In consideration of the photo/video services provided by the COMPANY for the CLIENT, the CLIENT agrees to indemnify and hold harmless the COMPANU, its affiliates, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or relating to any damage to the properties. This indemnification shall apply regardless of the cause of such damage, including but not limited to negligence, breach of contract, or strict liability.

Agreement to Terms and Conditions:

By submitting payment for the services provided by Zamora Digital Studios, the client acknowledges that they have read, understood, and agreed to abide by the terms and conditions outlined in this document. The client further acknowledges that these terms and conditions constitute a legally binding agreement between the client and Zamora Digital Studios. Payment of the invoice serves as explicit acceptance and consent to be bound by the terms and conditions set forth herein.
